How overtime works: Ontario, Canada
- Overtime is measured per work week. The general threshold is 44 hours. Higher thresholds apply to some jobs under Ontario regulation 285/01, for example 50 hours in some hospitality and cartage work and 60 hours for transport truck drivers.
- A contract may set a lower threshold or a higher premium than the legal minimum.
- There is no daily overtime threshold for pay. Daily limits relate to written agreements for working excess hours.
- With a written averaging agreement, overtime can be calculated over a period of two to four weeks. Straight pay is still due for all hours worked, and only the extra half-time premium can be deferred.
- Instead of overtime pay, an employer can give paid time off in lieu, at 1.5 hours for every overtime hour, taken within three months (or within twelve months if the employee agrees).
- Some employees are exempt from overtime rules.
Example: a week with 8 overtime hours (threshold 44 hours, 1.5x)
